Assume A has been drinking alcohol in a bar.  A left the bar, intending to drive home safely.  Unfortunately, on the way home A caused an accident with a car driven by B.  B was injured and the accident was the fault of A.  A was tested and found to be driving with a blood alcohol count above the legal limit.  A was arrested and convicted of driving under the influence.

Under California law that you have read, is B able to receive an award of exemplary damages against A.
