Description
After you have read the brief article on exemplary damages accessible through the link in the first page of Module 7 plus the summary of the case of Grimshaw v Ford Motor Company in your textbook at pages118-120 (pages 106-108 of the 4th edition), address this question:
Assume A has been drinking alcohol in a bar. A left the bar, intending to drive home safely. Unfortunately, on the way home A caused an accident with a car driven by B. B was injured and the accident was the fault of A. A was tested and found to be driving with a blood alcohol count above the legal limit. A was arrested and convicted of driving under the influence.
Under California law that you have read, is B able to receive an award of exemplary damages against A.
Briefly state your response and legal reasons.
